In a significant development, the Economic and Financial Crimes Commission (EFCC) has announced a comprehensive overhaul of its arrest and bail procedures, including the prohibition of nighttime sting operations. This revamp is part of the EFCC's commitment to adhering to the rule of law and respecting the rights of suspects.
The directive was issued by the EFCC's Chairman, Ola Olukoyede, in response to the recent arrest of 69 suspected internet fraudsters by the Ibadan Zonal Commission in Ile-Ife, Osun State.
The EFCC expressed its dedication to ensuring that all its commands adhere to the newly revised procedures on the arrest and bail of suspects. In an official statement, the EFCC reaffirmed its commitment to upholding the rule of law in carrying out its responsibilities.
The statement highlights the key changes:
1. Ban on Nighttime Sting Operations:
The EFCC has ordered the immediate cessation of nighttime sting operations across all its commands. This decision aims to enhance transparency and professionalism in the commission's activities.
2. Limiting Detention Period:
Suspects cannot be detained beyond the period allowed by the constitution without a remand warrant. This change emphasizes the protection of suspects' rights and ensures that detention is in line with legal standards.
3. Passport Submission:
Citizens will no longer be required to submit their international passports as part of their arrest procedure. The EFCC will exercise discretion in demanding passports based on the nature of the case, the personality of the suspect, and their country of residence.
The statement further warns EFCC officers against violating the rights of suspects, calling for professionalism in all operational activities. It underscores the need for a paradigm shift and adherence to international standards, reinforcing the EFCC's identity as a flagship law enforcement agency.
Background: The directive follows public backlash after the EFCC's arrest of 69 Obafemi Awolowo University (OAU) students. The anti-graft agency had conducted a raid at off-campus hostels, specifically at the Fine Touch and Superb hostels in Oduduwa Estate, Ile-Ife. This operation sparked concerns about the rule of law and due process.
In response to the operation, Governor Ademola Adeleke of Osun State instructed the state's Attorney General to collaborate with the school administration and student union leadership to safeguard the students' rights and ensure strict adherence to due process.
The EFCC subsequently confirmed the release of many of the suspects who had been duly profiled by the Command, with the remaining profiling to be completed without further delay.
This revamp in arrest and bail procedures reflects the EFCC's commitment to enhancing transparency, protecting suspects' rights, and upholding the rule of law in its operations.
