New Zealand Immigration Ends 90-Day Trial Periods for Accredited Employer Work Visa Holders
New Zealand's immigration agency has implemented significant changes that impact employment agreements for individuals on an Accredited Employer Work Visa (AEWV). Effective from October 29, 2023, these changes aim to promote fairness and address legitimate labor shortages.
The removal of 90-day trial periods for migrant workers is a pivotal part of these changes. This move serves to protect migrant workers from exploitation and unjust treatment, requiring employers to hire them only when a genuine labor demand or skills gap exists.
Additionally, the AEWV Category now mandates that accredited employers placing migrants in specific construction occupations must have at least 35% of their labor-hire workforce composed of New Zealand citizens and residents in full-time employment.
Immigration New Zealand (INZ) has adjusted the AEWV assessment process, resulting in longer processing times. Employers are strongly advised to apply for accreditation and job checks at least six weeks in advance.
For work visa holders, this means that trial periods are no longer allowed in their employment agreements. Therefore, it's crucial for those offered a job with a New Zealand employer to review their employment agreements carefully. If a trial period is included, it is advisable to contact INZ promptly.
Furthermore, New Zealand's processing times for AEWV applications have increased. Employers should plan well in advance for both accreditation and job checks.
These changes also have implications for new applications under the Green List. New Zealand intends to expand its Green List to include various professions in construction, information technology, automotive, and engineering. This expansion will enable professionals in these fields to utilize Green List visas when seeking specialized talent not readily available in the local workforce.
